I would like to know what actions will be taken if she uses the opportunity, using city resources, to defend herself in her recall campaign. I believe using city resources in a campaign is illegal. Can anyone knowledgeably address this issue?

The Michigan Campaign Finance Act (MCL 169.257) prohibits a public body from using public resources to make a contribution or expenditure for the purpose of influencing the nomination or election of a candidate, or for the qualification, passage, or defeat of a ballot question.

The purpose of the prohibition is to separate the government from politics to maintain government neutrality in elections, preserve fair democratic processes, and prevent taxpayer funds from being used to subsidize partisan political activities.

If Mayor Daniels violates the act, a complaint can be filed with the Secretary of State. If the SoS dismisses the complaint, the complainant may bring a civil action against the public body to seek declaratory, injunctive, mandamus, or other equitable relief and to recover losses that a public body suffers from the violation of this section.

Any money awarded or equitable relief granted by a court may be awarded or granted against the public body or an individual acting for the public body, or both, as determined by the court.

A person who knowingly violates the MCFA is guilty of a misdemeanor punishable, if the person is an individual, by a fine of not more than $1,000.00 or imprisonment for not more than 1 year, or both.

Every incumbent office-holder uses State of the City, State of the State, State of the Union addresses to promote the good things they are doing. That’s why it’s so hard to unseat incumbents and why we need term limits at all levels of government. Why should Mayor Daniels be criticized for doing it, especially since she has to defend her seat three years early in November?

You forced her to raise money and campaign for an extra election (3 years early!) against an unknown opponent and then accused her of moving the date from the spring to the fall for political gain. Seems fair enough to me, but maybe she had other reasons that we don’t know about.

Good luck filing yet another complaint with the government, wasting more tax money! By the way, the recall has already cost the taxpayers plenty (a panel of judges looking over the proposal, city employees figuring out what happens if it’s successful, etc.) Salaries of government employees aren’t free. If they were sitting around waiting for something to do we wouldn’t need them.

You have every right to do file petitions and ballot proposals, but please quit saying it costs the taxpayers nothing.

Were any of those people facing recall in a month's time? The recall hasn't cost the taxpayers a dime. Private donations have paid for it, and the recall election is a sunk cost. Do you understand that concept Dale?

No one forced her to do anything. She could have easily resigned (which would have been the better option by far), but she CHOSE to fight the recall.

Remember, Dale, that your argument that taxpayer money has been spent on the recall effort is a double edged sword. PLENTY OF TAXPAYER MONEY has been spent in the service of the Mayor's own frivolous requests and demands. A packet of FOIA documents from early in her tenure show a woman more concerned with her image on city websites and requests for other frivolous things than with any substantive work of the city. That we paid city employees to worry about that disturbs me, and as a so-called fiscal Conservative...should greatly disturb you, too.

Dale, Why do you continue to try to mislead people? You have been corrected numerous times regarding your misinformation of facts. THERE IS NO EXTRA ELECTION! As far as the panel looking over the proposal, that is their job. What about the ten fictitious proposals that Janice's buddy Nick made them review? Common sense tells you that that costs more than the one currently on the ballot. I hope people who are reading this have keyed into your trying to mislead them.

And, yes, she did move the State of the City address from when it is typically given; i.e. Jan. or Feb. This was just another of her political ploys.

These actions are another indication of her misuse of her position and reason to VOTE YES TO RECALL JANICE DANIELS.

By the way, Dale, what good things has she done since being elected? If you listen to her State of the City, she was not instrumental in any of the accomplishments.

The simple fact is that Janice Daniels has had no positive impact on this city. She was not able to speak to any accomplishment for which she is responsible, and any positive highlights of the city's progress are due in very large part to the previous council and city administration. Other positive growth in the city would have happened regardless of who holds the seat of Mayor.

Did this event really mean anything? I kind of feel like it was really only noticed by people who have already made up their minds about the mayor and the recall. Is it really going to change anyone's mind? Will undecided voters take notice? I don't think so.

I agree completely. The mayor’s detractors are finding fault, as usual. The rest of us were doing other things that night.

Most people in Troy are living their lives and are not aware of the drama in the city council. The main reason I’m involved in the current controversy is because I was opposing the transit center as wasteful spending and came to some council meetings when this all got started. Otherwise I wouldn't have known much about it.

Just because I think there will be no impact on the recall, that does not mean I think she exempt from criticism. There most certainly is fault to be found here.
