Man Caught Removing Legally-Placed Recall Yard Signs

A 62-year-old Troy resident may face charges stemming from the Tuesday afternoon incident.

 

A Troy man may face charges after he illegally removed five yard signs Tuesday afternoon from the corner of East Long Lake and Rochester Roads.

The 62-year-old man was removing several Recall Janice Daniels yard signs from the Meadowbrook Plaza shopping center when a recall supporter confronted him.* Per Patch policy, the man's name is not being published unless he is charged.

“We’ve been doing stakeouts," Recall Janice Daniels co-founder John Kulesz said. "They’ve been disappearing as quickly as five minutes after we put them up."

Kulesz, who was not one of the two individuals watching the signs on Tuesday, said the man "pulled up and started taking our lawn signs down and throwing them in the trunk of the car.”

"The signs were legally placed," Troy Police Capt. Robert Redmond said Wednesday. "We took a police report. It will be turned over to the city attorney’s office for review."

"We will pursue that as we would any other request for a criminal charge,” Troy City Attorney Lori Grigg Bluhm said Wednesday, adding they must determine if there is enough evidence to proceed. “We want to look at this fairly quickly."

According to the police report, the man told Troy officers he had graduated from the Troy Citizens' Police Academy this spring, during which he said he was told by Paul Evans, Troy Zoning & Compliance Specialist for the City of Troy, that private citizens could remove illegally-placed signs. He added he thought the signs were placed within 20 feet of city property, "so he removed them."

However, Evans told officers he "has never given permission to anyone to remove signs on city property," according to the police report. In Troy, trained volunteers who are authorized to remove signs do so in pairs, he said.

Earlier this month, both Recall Janice Daniels and No Troy Recall supporters reported signs being taken from yards across Troy. Troy Police Chief Gary Mayer said in an Oct. 9 interview with Patch that those caught stealing the signs or possessing stolen signs could face a misdemeanor charge, which can include up to 90 days in jail as well as a fine.

So childish and pathetic. So the people who claim they are fighting for Janice Daniels' "freedom of speech" are trying to obstruct other peoples freedom of speech? The irony is overwhelming.

My sign disappeared while we were out of town for a few days. Did it just blow off the frame? My other signs were left untouched so I am suspicious. I am in the Long Lake/John R area.

I've been noticing "YES" signs disappearing from prominent thoroughfares while "NO" signs remain. Now I see it is not a coincidence. This reflects so badly on the "NO" recall people, that they would break the law to win.

I don't understand how anyone could misunderstand about whether or not they are a legitimate sign enforcement volunteer with the Planning Department. My husband and I attended not only Citizens Academy, but we also attended training for volunteers, rode along with a city employee for additional training, have picture ID's as city volunteers for sign enforcement. We were told we could ONLY act as sign enforcement volunteers when we were in a city vehicle, during our regularly schedule shift from 9AM to 12 Noon on Saturdays, wearing our city issued photo ID's. We are scheduled in advance by the Planning Department, and there are NO volunteers working on Tuesdays. My husband and I are proud of the work we do for the city. We certainly are aware of the difference we make when we drive through other cities!

A few years back before code enforcement was privatized, I, along with my neighbors and our association directors were told we could remove illegally placed signs in our subdivision. The entrances of our subdivision looked so cluttered during campaign season and that was the #1 complaint from our residents. Not to mention, many times the landscaping on the entrance islands would get trampled. HOWEVER, we were told to be very careful and very considerate while removing signs. It was suggested we contact the candidate first AND have the sign easily available for them to pick it up AND to never throw the sign away. I removed a few illegally placed signs when I was an association director, I contacted the candidate and each time they were very appreciative. Sometimes they have volunteers who place their signs illegally and they were unaware.

I think Stacy the difference was that the property belonged to the subdivision, and reps of the sub were removing the signs. That would be like me taking a sign that someone put in my yard. The sign enforcement volunteers remove signs for the city from public property, not private property.

No, the entrances are city property, along with all the cul de sacs. I think the difference from then to now is there was not so much fighting, pettiness and divide. It was more of a 2 way consideration, the residents didn't like the clutter, regardless of the candidate and the candidate didn't want to lose a sign. No way now will I ever remove an illegally placed sign, nor will I call the candidate. If it bothered me that much I'd call the city. It's too nasty in the Troy political playground.

No one told you to do anything. You went and did this on your own. Knowing full well what you were doing. You were intentionally by the slight of night removing signs from peoples yards. Do you go around and remove yard decorations during the holidays as well. This would apply to your argument as well. Why were you deceitful? Why didn't you go and inform the neighbor about their sign and have them place it in a different part of their private property, you theif. Nothing you say makes any sense Tin Hat.

Yes, innocent until proven guilty. Interesting to note also, according to the story, the accused was fact checked and found to not be truthful about what Mr. Evans from code enforcement told him.

Hi Concerned Citizen - nice line but incorrectly applied. The correct cliche for this case would be - ignorance of the law is no excuse.
When I have posted signs, I was told that only the city can remove signs. This is about respect. It's about fairness and honesty in elections.
Pulling down legally placed lawn signs and then destroying them isn't fair play. It's cheating.

Cheating to win is the only thing Mayor Daniels and her tin hat band of supporters know how to do. I firmly believe they are such zealots they think they are part of some righteous cause, and thus can rationalize their illegal acts and endless deceptions. They would all tell you they are patriots, yet engage in the most un-American behavior possible. Throw the book at this guy...maybe it will teach them a lesson.

It's interesting that he had a story ready in case he was caught. It's sad that it was so poorly thought out. It's a movement folks. It's win at any cost. It's typical and discouraging at the same time. By the way, word on the street is that the Lipton folks will have a half to a dozen outside volunteers at each polling location to try to sway your vote at the last possible minute. They believe this is a national issue, and not just that they flat out promoted an unqualified person for the position. Again, it's not a conservative of liberal issue. It's not a national issue. It's a local issue, and should remain so, without outside interference.

There are strict rules of engament at the polling booths. You are not allowed to engage with the voters, you have to keep a distance from the entrance, etc. Supporters of the "Yes Recall Daniels" should be there to make sure these rules are enforced.

KW, in addition, you can not be interfered with on your way into the polls. No bribery, menace (heckling) or other corrupt means to influence an elector (voter) or deter the elector in giving their vote. Violation of this law is a felony. If someone insists on stopping you, or harasses you, report it to the poll workers. Or call the police. Use your phone to take pictures of violations. (Election law 168.932 Prohibited conduct)

While there are many of these political signs I would personally like to remove, the huge difference is I don't. I possess a compass in my moral fiber disaalowing me of such action. I simply do not look at the ones I wish would disappear, and, you know what? They do. Of course, I have been seeing many, many Yes to Recall these days. I do not see any No. Are there any?
