I would like to see candidates that understand that a city government that serves the interests of a community is not the same as running a business for the profit of the business owner, or like managing a household and its budget.   more ›

Judge Orders May 2013 Special Election for Troy

"The court finds that fairness in the election process mandates that timely notice be rendered," said Judge Denise Langford Morris. "Therefore, the court finds that the next regular election date is in May."

PONTIAC – Oakland County 6th Circuit Court Judge Denise Langford Morris on Wednesday afternoon ordered a May 2013 special election for Troy to elect a new mayor. The decision marks the tentative end to a nearly month-long battle between the City of Troy and the Secretary of State's office after Council voted on Nov. 21 not to seek further advice from the state on how to replace former Troy Mayor Janice Daniels, who was recalled on Nov. 6. Carmen Johnson is clearly a TCU candidate. She should feel free to run in November, but she should not be appointed. She was actually a Treasurer for a Doug Tietz campaign. (Tietz has exhibited, several times, that he is more interested in serving his party than the city.) It would be best if council chose someone not affiliated with any of the outspoken groups here in Troy.   more ›

Secretary of State Sues Troy, Says 'State Law Requires An Election'

Secretary of Sate Ruth Johnson filed a lawsuit Friday against the Troy City Clerk Aileen Bittner, saying Troy residents "have the right to choose the city's mayor in February."

LANSING, Mich. — Secretary of State Ruth Johnson and Attorney General Bill Schuette issued a joint statement Friday afternoon on the lawsuit they filed against Troy City Clerk Aileen Bittner Friday in Oakland County Circuit Court. In the lawsuit, they claim the City has violated state law by not calling a special election on in February and instead choosing to follow City Charter by appointing Dane Slater mayor until the November 2013 city election. “I’m disappointed that city officials have chosen to go this route,” Johnson said in a press release Friday evening. “Unfortunately, we now must seek a legal remedy to uphold state election and recall law. Our position all along has been that state law requires an election in this situation. …

City Responds to Attorney General; Troy, Secretary of State Sued

In a final effort to avoid a lawsuit from the Michigan Attorney General's office, City Attorney Lori Grigg Bluhm responds Friday in a letter to its chief legal counsel.

Less than a day after the Michigan Attorney General's office threatened to sue Troy if it did not call a special election in February, Troy City Attorney Lori Grigg Bluhm once again defended the city's decision Friday to wait till November 2013 to hold an election to replace recalled Troy Mayor Janice Daniels. In the letter to Attorney General Bill Schuette's Chief Legal Counsel Richard Bandstra, Bluhm said Troy can satisfy both the state election law as well as the City Charter by holding a November 2013 election. "The City of Troy acknowledges that there is ambiguity in the recall and subsequent election process as provided under Michigan election law," Bluhm wrote, in part, in her two-page letter. "We are committed to uphold both State …

State Attorney General to Troy: Call Election or We'll Take You to Court

Richard Bandstra, chief legal counsel for State Attorney General Bill Schuette, responds to the City's Tuesday letter refuting the need for a February election to replace recalled mayor Janice Daniels.

The chief legal counsel for Michigan Attorney General Bill Schuette has told Troy: Either order a special election on Feb. 26, 2013, or face litigation. Troy leaders, however, continue to fight with the state for the ability to hold off on electing a new mayor until November of next year. "After careful review of the provisions of Michigan's Election Law and the City of Troy Charter, it is the position of this office that a special election should have been called for February 2013 to fill the remainder of the unexpired term following the recent successfull recall of former Mayor Janice Daniels," Schuette's Chief Legal Counsel Richard Bandstra wrote. In the two-page letter from Bandstra to Troy City Attorney Lori Grigg Bluhm and other city…

City Defends Right to Appoint Mayor in Letter to State

Troy City Attorney Lori Grigg Bluhm responds to state Director of Election Christopher Thomas' Monday letter ordering a Feb. 26, 2013 special election.

Troy City Attorney Lori Grigg Bluhm, in responding to a letter sent to her late Monday afternoon from state Director of Elections Christopher Thomas, sent a letter Tuesday challenging Thomas' reasons for ordering a special election on Feb. 26, 2013, to elect a replacement for Janice Daniels, who was recalled on Nov. 6. Thomas' letter arrived the same day Troy City Council voted 4-2 to appoint Dane Slater Mayor of Troy until the Nov. 5, 2013 regular election. "This letter is in response to your letter of November 26, 2012, to Troy City Clerk M. Aileen Bittner, which was sent via e-mail at 5:30 pm," Bluhm wrote. "It was received after the fifteen day candidate filing deadline set forth in MCL 168.971, which is the statutory recall provision …

State Orders Special Election for Troy; City to Refute Order

City administrators are drafting a response to a letter from the state director of elections ordering a special election in February to elect a new mayor.

In a letter sent Monday to Troy City Clerk Aileen Bittner and City Attorney Lori Grigg Bluhm, state Director of Elections Christopher Thomas directed the city to conduct a special election in February "to fill the vacancy created by former Mayor Daniels' recall." The letter arrived the same day Troy City Council voted 4-2 to appoint Dane Slater Mayor of Troy until the Nov. 5, 2013 regular election. "I understand the City's legal position to be that, pursuant to the Troy City Charter, the City intends to allow the person who was recently appointed to temporarily fill the vacancy in the office of Mayor to serve until a successor is elected at the next regularly scheduled city election" next November, he wrote. However, he asserted, the …

City Turns Away 2 Applicants Seeking to Run for Troy Mayor in February

Ed Kempen and Dan Brake left paperwork with the City Clerk Monday afternoon.

On Monday afternoon, two Troy residents – Ed Kempen and Dan Brake – attempted to turn in paperwork to run for mayor on Feb. 26, 2013.  According to a press release sent late Monday afternoon from Concerned Troy Citizens, whose members spoke out against the city's decision to follow its charter instead of state statute at last Wednesday's special meeting, the City Clerk "walked away from the two candidates without accepting the paperwork under the watchful eye of Troy's City Attorney Lori Grigg Bluhm." However, Troy City Clerk Aileen Bittner said the City could not accept the paperwork, since there is currently no election scheduled for February. At Monday evening's Troy City Council meeting, Council voted 4-2 to appoint Dane Slater as …
