Suit Against Troy Mayor, City Council Dismissed

A lawsuit filed under the state Open Meetings Act by a Troy resident against the city, Troy City Council, and each individual councilmember was dismissed earlier this month.

Charlene Femminineo, 62, filed suit on April 15 at federal court in Detroit after her comments at a Nov. 26 council meeting were stricken from the city's official minutes and cut from rebroadcast by a vote of the council, city attorneys wrote in a July 3 memo to council. Femminineo's speech at a Dec. 3 meeting was stopped based on a claim that she had violated the council's rules of procedure.

Judge John Corbett O'Meara issued an opinion in concurrence with city attorneys who had claimed the case was not viable after Femminineo's counsel did not respond to a motion for summary judgment.
