Rifle-Toting Troy Teen Sues City of Birmingham for Violating His Civil Rights

Sean Combs, 18, was arrested for carrying a rifle in downtown Birmingham in April; he was found not guilty of disturbing the peace and brandishing a firearm in July.

Sean Combs, the 18-year-old Troy resident who was arrested in April for openly carrying his loaded rifle through downtown Birmingham, filed a lawsuit Friday at Michigan Eastern District Court in Detroit alleging the City of Birmingham and three officers from the Birmingham Police Department violated his civil rights when they arrested him in April. Combs was found not guilty of brandishing a firearm and disturbing the peace by a seven-member jury on July 12 at 48th District Court in Bloomfield Township. A third charge of obstructing an officer was dismissed during trial due to lack of evidence. Rifle-Toting Teen Found Not Guilty; Jury Says: 'We Upheld the Law'

A seven-member jury found Troy's Sean Combs not guilty of disturbing the peace and brandishing a firearm after the 18-year-old was discovered carrying a firearm in downtown Birmingham in April.

Sean Combs, the Troy 18-year-old arrested for carrying a rifle in downtown Birmingham, was found not guilty Thursday afternoon of brandishing a firearm and disturbing the peace. After nearly five hours of deliberation on Wednesday afternoon and Thursday morning at the 48th District Court, many on the seven-member jury were confident in their final decision. "We upheld the law," said Rev. Julius DelPino, a jury member from Rochester Hills. "Based on how the law is written, (Combs) was not breaking the law." Combs was arrested on April 13 after he was stopped by two Birmingham Police officers while he had his loaded M1 Garand rifle slung over his shoulder. Rifle-Carrying Teen's Trial Could Be Delayed

The judge overseeing Sean Combs' case is in the middle of a jury trial, possibly delaying the beginning of Combs' trial which is set to start Wednesday.

The trial for Sean Combs, the Troy 18-year-old facing charges after he was found carrying a rifle in downtown Birmingham, may be delayed. According to Combs' attorney James Makowski, Judge Marc Barron is currently in the middle of a jury trial so the first day of Combs' trial — set for 8:30 a.m. Wednesday — may have to be pushed back. Combs was at the 48th District Court Monday afternoon for an administrative pre-trial. Makowski said he and prosecuting attorney Mary Kucharek won't know if Combs is back on the docket for Wednesday until Tuesday. "I have to prepare for a trial I don't know will happen," Makowski said. Sean Combs, the Troy 18-year-old arrested in April after he was found carrying a loaded rifle through downtown Birmingham, will be in court Monday. Combs will come before Judge Marc Barron at 48th District Court at 1:30 p.m. Monday for a jury pre-trial. At Combs' evidentiary hearing on June 20, Barron also scheduled Combs' trial to begin at 8:30 a.m. Wednesday. Combs is charged with brandishing a firearm, disturbing the peace and obstructing an officer after an April 13 incident at the corner of Merrill and South Old Woodward. Sean Combs, the Troy 18-year-old arrested in April after he was found carrying a loaded rifle through downtown Birmingham, will be taking his case to trial. At an evidentiary hearing Wednesday at 48th District Court, Judge Marc Barron denied a motion to dismiss the three charges against Combs, submitted by his attorney James Makowski. Barron set a jury pre-trial for 1:30 p.m. July 9, with the jury trial set to begin at 8:30 a.m. July 11. Edythe, I kind of agree with you. Yes, it was legal, but it was extremely inappropriate and dangerous and in bad taste. I myself certainly do not walk down Birmingham streets with an 8 pound loaded rifle unconcealed - although it is my right to do so. It is still a stupid and needless thing for him to have done, and for what purpose? Its not fun to carry around a loaded 8 pound M1Garand rifle, so…   more ›
